Powers of the Racing Integrity Commissioner

Section 37C of the Racing Act 1958 (External link)[the Act] gives the Racing Integrity Commissioner [the Commissioner] the power to carry out his functions as outlined in Act and to do all things necessary or convenient in order for him to carry out those functions.

Section 37BA of the Act provides the Commissioner with powers to conduct an inquiry or investigation in respect of the following persons:

  • licensed under the rules of a controlling body;

  • person registered under the rules of a controlling body;

  • member of the Board of a controlling body;

  • an employee of a controlling body;

  • a member of a committee or other managing body of a club registered under the rules of a controlling body;

  • an employee of a club registered under the rules of a controlling body; and

  • any person who at the time the matter which is the subject of the inquiry or investigation occurred was a person referred to above.

During an investigation or inquiry, the Commissioner may summons persons or documents, administer an oath; and examine a person under oath. The Act also provides for offences and penalties for persons who fail to comply with these requirements.

Section 37E of the Act enables the Commissioner to disclose 'integrity related information', as appropriate, to agencies including, but not limited to:

  • A racing controlling body i.e. Racing Victoria, Harness Racing Victoria and Greyhound Racing Victoria;
  • A Racing Appeals and Disciplinary (RAD) Board;
  • Victorian Commission for Gambling and Liquor Regulation (VCGLR);
  • Victoria Police;
  • Australian Federal Police (AFP);
  • The Minister for Racing;
  • The Independent Broad-based Anti-Corruption Commission (IBAC);
  • The Victorian Inspectorate;
  • A person that controls, organises or administers an approved betting event;
  • Australian Transaction Reports and Analysis Centre (AUSTRAC);
  • Australian Taxation Office (ATO);
  • Australian Crime Commission (ACC);
  • Australian Securities and Investment Commission (ASIC);
  • Centrelink;
  • Customs;
  • Ombudsman Victoria;
  • Therapeutic Goods Administration;
  • Australian Pesticides and Veterinary Medicines Authority (APVMA);
  • Australian Racing Board;
  • Harness Racing Australia;
  • Greyhounds Australasia;
  • Northern Territory Racing Commission;
  • Thoroughbred Racing Northern Territory;
  • ACT Gambling and Racing Commission;
  • Racing Queensland Limited;
  • Queensland All Codes Industry Board;
  • Gaming and Wagering Commission;
  • Queensland Racing Integrity Commissioner;
  • Racing New South Wales;
  • Harness Racing New South Wales;
  • Greyhound Racing New South Wales;
  • Thoroughbred Racing South Australia;
